NA permission, Gunthewari and 7/12 in Maharashtra: a plot owner's guide

Most plot problems in Maharashtra are land-record problems, not construction problems. Here is how to read the 7/12, what NA (non-agricultural) conversion really means, where Gunthewari fits, and the checks we run on every plot before a quotation.

NA permission, Gunthewari and 7/12 in Maharashtra: a plot owner's guide

1. Reading the 7/12 (Satbara Utara)

The 7/12 is the land-record extract for rural/aggro plots: survey number, owner names, land use (crop/irrigated), area, encumbrances (loans, liens) and mutation entries. Check it on the MahaBhumekh portal (Mahabhulekh) free of charge. Read every column with our 7/12 online Satbara Utara reader.

What matters for construction: the use classification, that the seller's name matches the mutation entries, and that no pending litigation or loan is marked.

2. Agricultural land cannot be built on - until NA

Land classified as agricultural needs conversion to non-agricultural (NA) use before construction. Two states matter: 'deemed NA' - granted inside sanctioned layouts or under specific zone conditions, where the conversion is deemed on payment of fees - and 'sanctioned NA' - a formal conversion order from the Collector after the land is in a development-plan zone that permits residential use. Buy only with one of the two in hand, or with the conversion file already moving.

3. Gunthewari, regularised plots

The Maharashtra Gunthewari Developments (Regularisation, Upgradation and Control) Act covers plots subdivided on agricultural land without formal layout sanction — a common practice in the 1980s–90s belts around Pune and Baramati. Gunthewari plots can be regularised upon payment of development charges, but many remain partially regularised: the plot may be buildable while the access road or amenity space is not conveyed. Always verify the official regularisation order, not just the use of the term 'Gunthewari'.

4. How to legalize a gunthewari plot (regularisation, step by step)

Legalising an unregularised gunthewari plot runs through the Tahsildar / Collector (Land Records) office that covers the subdivision — there is no fully online end-to-end process, so budget office visits.

  1. 01Step onePull the 7/12 and confirm the parcel is still shown as the subdivided plot you were shown on the ground.
  2. 02Step twoApply for regularisation with the 7/12, the plot layout/measurements, the chain of title documents and the prescribed development charges (plus any penalty the office assesses).
  3. 03Step threeOnce the regularisation order issues, check that the internal roads and amenity space are conveyed to the gram panchayat or the society — this is the step most sellers skip.
  4. 04Step fourOnly then does the plot carry deemed-NA or become eligible for an NA order and building permission.

5. Gunthewari check online: verify a plot before you pay

A gunthewari check online takes four steps, and none of them cost money. First, pull the 7/12 free on the MahaBhulekh portal - confirm the use classification and that the seller's name matches the mutation entries. Second, ask for the Gunthewari regularisation order and check the development charges were actually paid; the order sits with the Tahsildar / Collector (Land Records) office that regularised the subdivision. Third, confirm the NA status - an NA order in Maharashtra is either deemed (inside a sanctioned layout) or a formal Collector's order - and an 'applied' NA is not an NA. Fourth, cross-check the layout sanction and whether roads and amenity space are conveyed. Our free NA / Gunthewari checker tool runs the first pass online in minutes; the site visit settles the rest.

6. The NA conversion process, and how to verify an NA order

To initiate the NA conversion process, submit an application to the Collector or Tahsildar with the 7/12 extract, a zone certificate from the planning authority, the layout or amalgamation order, and payment of the conversion fees, which are determined by the land's value and designated use. Timelines for approval typically run in months, not weeks, and fees differ significantly depending on the zone.

If the land lies within a sanctioned layout, the developer usually holds the NA order. Your primary verification should be the layout sanction and the individual plot's release letter.

  1. 01To verify an NA order you hold: request a certified copy of the order, including the order number and date.
  2. 02Confirm that this order number is recorded in the remarks column of the current 7/12 extract.
  3. 03A genuine NA conversion is always reflected in the 7/12 via a Ferfar mutation.
A genuine conversion is always carried into the extract via a Ferfar mutation.

7. The red flags we check before quoting

  • Seller name not matching the mutation entries
  • gaothan or wada plots without a clear title chain
  • plots inside layouts whose amenity space is not conveyed to the society
  • NA orders with conditions (tree plantation, access width) not yet fulfilled
  • plots under acquisition (road widening, reservoir)
  • 'collectors' plots sold on power of attorney without registered sale deeds

8. How we verify plots

  1. 01Verify legal documentsPull the 7/12 and zone certificate, check the layout sanction and NA order.
  2. 02Conduct site inspectionWalk the plot boundaries against the layout and confirm access width.
  3. 03Use online toolsUtilize the free 7/12 checker and NA / Gunthewari checker tools for initial online verification.
  4. 04Complete verification processThe site visit completes the verification process after the online tools' first pass.

9. NA application form: get the PDF and file online

A Maharashtra NA permission application - the "Application for Non-Agricultural Permission" - is available as a downloadable PDF from the MahaOnline portal (mahaonline.gov.in) and the Collector office pages (search "NA permission form pdf Maharashtra"). The two forms to know: the NA 8-A application for conversion to non-agricultural use, and the NA 8-B for continued NA / building permission. Filing is online through MahaOnline for most divisions - apply for NA permission online under Land Revenue → Non-Agricultural Permission - attaching the completed PDF, the 7/12, Index-II, layout and zone certificate, with e-payment of the NA charges. Offline, the same pack goes to the Tahsildar / SDO / Collector (Land Records) desk. Whichever route you use, keep the certified order copy: that order number must appear in the 7/12 remarks column before the conversion is truly on the record.

FAQ

Real questions, real answers.

Can I build on agricultural land in Maharashtra?

+

Only after NA (non-agricultural) conversion - either deemed NA inside a sanctioned layout or a sanctioned NA order from the Collector. Building on unconverted agricultural land is unauthorised construction.

How do I check a 7/12 online?

+

Free on the MahaBhumekh (Mahabhulekh) portal by district, taluka and village - enter the survey or gat number. Our 7/12 checker tool walks you through it and flags what to look for.

What is the difference between deemed NA and sanctioned NA?

+

Deemed NA applies inside sanctioned layouts (conversion deemed on fee payment). Sanctioned NA is a formal Collector order converting a specific parcel. Both are acceptable - an 'applied' NA that has not been granted is not.

Are Gunthewari plots safe to buy?

+

They can be - after verification. Check the regularisation order, whether development charges are paid, and whether roads and amenity space are conveyed. Partially regularised plots are the common trap.

How do I legalize a gunthewari plot in Maharashtra?

+

Apply at the Tahsildar / Collector (Land Records) office covering the subdivision: 7/12 + plot measurements + title chain + development charges (and any penalty). Once the regularisation order issues, confirm the roads and amenity space are conveyed, and only then treat the plot as buildable - it then carries deemed-NA or becomes eligible for an NA order. There is no fully online end-to-end process.

How can I verify an NA order in Maharashtra?

+

Ask for the certified order copy (order number + date), then check that the order number is recorded in the remarks column of the current 7/12 - a genuine NA conversion reaches the extract through a Ferfar mutation. If the 7/12 still reads purely agricultural, the order is not on the record. There is no single public portal for NA order search, so the extract is the verification.

How long does NA conversion take?

+

Months, not weeks - it depends on the zone, the Collector's office and whether the parcel sits inside a sanctioned layout. Buy with the NA in hand or the file already sanctioned.
